PerksCard Terms and Conditions
By activating or otherwise using the PerksCard, you are agreeing to the following terms and conditions (these “Terms and Conditions”). You understand that Augeo Affinity Marketing, Inc., and its subsidiaries and vendors and partners (collectively, “Augeo”) make available online information and services to cardholders of this discount program (“Cardholders”). By activating or otherwise using the PerksCard, you are indicating that you are 18 years old or older and agree to be bound by this Agreement. You acknowledge that these Terms and Conditions may be modified at any time. Any changes will appear on this page. It is your responsibility to refer to these Terms and Conditions prior to using the PerksCard. You will be deemed to have accepted any change to these Terms and Conditions if you register, use or continue to use the PerksCard after that change has been posted here.
The PerksCard is a discount program that provides Cardholders with savings and benefits offered by participating merchant locations in the United States and online.
Cardholders must be U.S. Residents and at least 18 years of age to participate, unless a specific program or client allows for international participation.
2. Registering the PerksCard
Registration of the PerksCard is not required to receive in-store discounts from participating merchants. However, in order to access the online benefits and features, you may be required to create an account and register your PerksCard. When you create an account or register a PerksCard, you must provide with accurate and complete information (including but not limited to card number, username, password and zip code) and advise of any changes by updating your online profile or contacting PerksCard Customer Service. PerksCard will use this information to create your account, register your PerksCard and, where applicable, provide you with new discount program information.
Those who complete the Cardholder registration form are responsible for submitting correct personal information during the time of registration. Cardholders who do not wish to participate in this discount program are not required to submit their address information in order to become a registered member. Any future changes required by a Cardholder must be submitted by the Cardholder via his or her account. Any change made by a registered Cardholder is the sole responsibility of the Cardholder.
When you register your PerksCard online, you will be asked to create a password to view your account. You may not select a password that violates anyone’s rights or one that, in Augeo’s sole discretion, is considered offensive, improper or inappropriate. If you do so, Augeo may modify or delete it.
Augeo does not permit the sharing of your PerksCard, number, password or discounts with any other person. If Augeo reasonably believes that any of your PerksCard materials are being used in any of these ways, Augeo reserves the right to cancel your PerksCard and/or your Cardholder rights immediately. If you believe someone has used any of your PerksCard materials without your authorization, please contact PerksCard Customer Service.

3. Using the PerksCard
Your PerksCard and number provide you access to certain savings, benefits and services. You must register your PerksCard to access the complete savings, benefits and services, but you can receive discounts at participating merchants without registering the card. Visit www.perkscardnetwork.com to register your PerksCard. The PerksCard is nontransferable and may only be used by the person whose name is associated with the card number.
Use of your PerksCard at a participating merchant’s location:
You must present your PerksCard before you make a purchase at a participating merchant. A merchant has the right to deny a discount if you do not present your PerksCard before payment. Certain participating merchants must swipe your PerksCard through their terminal in order to deliver certain savings, benefits and services.
Use of your PerksCard online:
You can access the benefits of PerksCard online by visiting www.perkscardnetwork.com and signing in. Certain featured offers, online shopping benefits and other benefits will require registration. Other benefits may be available to any visitor. A PerksCard may not be required to take advantage of the online services. However, many services may be offered only to Cardholders. Any visitor to PerksCard is required to abide by the terms and conditions hereof.
Any use of the PerksCard or the associated Cardholder benefits and discounts in a manner that violates the rules or regulations of any participating merchant or online partner is prohibited by this Agreement and is grounds for termination of your right to use the PerksCard, and will result in a forfeiture of any savings, benefits and services. Augeo reserves the right to cancel your Cardholder rights immediately in the event of such a violation.
4. Tracking Cardholder Activity
Augeo uses various tracking technologies in conjunction with third party advertising affiliates. In most cases, the tracking used may require a cookie to be placed onto the Cardholder’s computer. This is required in order to fully track the Cardholder activity and to assure that the Cardholder is credited for any completed application for a specified product or service. Cardholders must have their browser enable cookies in order to part take in this discount program.
5. Lost PerksCards
If your PerksCard is lost or stolen, you can report your missing card by contacting PerksCard Customer Service by sending an e-mail to email@example.com.
6. Expiration and Cancellation
Your PerksCard may be subject to expiration and cancellation at the discretion of Augeo following any breach of these Terms and Conditions by a Cardholder, termination of a sponsor, or termination of a particular program. A Cardholder will no longer be entitled to any discounts, benefits or rewards following the expiration or cancellation of a PerksCard. Discounts, benefits and rewards not redeemed by the date that a PerksCard is cancelled shall be forfeited.
7. The Web Site
The perkscard.com web site (the “Site”) offers the most up-to-date information on savings and partner benefits offered by participating merchants. Augeo is not responsible for third parties’ restrictions or changes to their offers. As a Cardholder, you will have to log in to access certain sections of the Site, using your username and password.
When changing information on your account, you agree to provide accurate and complete information.
You can search for savings and participating merchants online. When you wish to purchase goods or services online at the Site or at a participating merchant’s web site, you may be required to enter your PerksCard number or a promo code in order to receive the discount. Some merchants and discounts may not be available in your community. Every effort has been made to make sure that all information is accurate within PerksCard, but there is no guarantee and/or warranty to the accuracy of any information found within the Site. Participating merchants’ contact information has been provided for Cardholders. This information is believed to be accurate during the time of publishing, but Augeo will not be held liable for any inaccuracies. You should contact the participating merchant in advance to confirm it offers the discount. Even though Augeo makes efforts to keep the listing of participating merchants and savings up to date, Augeo is not responsible for incorrect or incomplete information regarding the participating merchants or their discounts. You may submit corrections for participating merchants or discounts in an email to firstname.lastname@example.org.
The Site may be used to contact the PerksCardholder Services department. For questions, concerns or suggestions e-mail email@example.com. An agent will answer your e-mail within 72 hours.
At any time, the Site may contain links to other web sites throughout the Internet; any links to such sites are operated and/or owned by third parties. Augeo and Augeo’s clients and/or customers may not be held liable for any inaccuracies of these links, availability of information, and/or the content of information that may be found within third party web site(s). During times of maintenance or other unforeseen occurrences, Augeo and/or merchants who participate in the discount program may be temporarily unavailable. Down times may vary and may be the result of various circumstances, many of which may not be the sole responsibility of Augeo. Nevertheless, during such circumstances, Augeo will actively work on resolving the problem, but Augeo and Augeo’s clients and/or customers cannot be held responsible for any for any inconveniences or loss of discounts, benefits or rewards of Cardholders.
Augeo is not associated with the participating merchants or any other U.S. company or organization (private, public, or governmental) that may be listed throughout the Site, except for affiliate programs that advertise their products or services throughout Augeo, either through banner advertisements or direct text links.
Augeo makes no claim of any form of relationship or ownership to any of the logos or trademarks of any merchants listed throughout the Site.
No information or content found within the Site may be copied for commercial or noncommercial use without the prior written consent of Augeo.
You understand and agree that the use of the Site is for use at your own risk. No liability shall be held against Augeo for any interruption in service, or for any inaccuracies, or lack of reliability of which may be involved, nor does Augeo warrant against the results of such possible incidences that may cause damages and/or inconveniences to the Cardholder. Augeo will not be held liable for any possible consequential, or any indirect damages that may be brought upon by the use, or inability to use the Site.
Augeo may suspend, change, or stop the service, or any aspect of the Site at any time during operation, including but not limited to merchant information, databases or other content without any prior notification or liability.
8. Discount Program
You can pick up a free PerksCard at participating local merchants. See www.perkscardnetwork.com for an up-to-date listing of participating merchants. When making a purchase at a participating merchant, Cardholders must show or swipe their PerksCard to calculate the discount, reward or other benefit they will receive. The participating merchant will immediately take the discount off of the purchase price at the point-of-sale. Periodically, promotions, incentives or other benefits associated with swiping or registering a PerksCard may be offered. These promotions will be communicated on the Site and may be communicated directly to customers who have registered and agreed to receive program announcements.
Augeo reserves the right to add, remove, and/or update any service provided within this discount program. Augeo may contact Cardholders about any additional services and/or adjustments to this discount program. However, Augeo has no obligation, under any circumstance, to contact Cardholders about changes made to the program.
9. Merchants, Discounts and Merchant Products
Augeo and PerksCard merchants are independent contractors. Augeo is not responsible for the discounts, rewards or bonus services offered by any merchant. Augeo is not responsible for the delivery of any discount, conduct of the merchant or changes by the merchant of its discount for any reason. Merchants may not discount all products offered for sale and stated discounts may vary at the point of purchase.
Augeo makes no warranty, expressed or implied, about any goods and services purchased from a merchant. Each Cardholder will look solely to the merchant for any and all discounts, returns, performance and nonperformance, warranty service and/or any damages suffered by a Cardholder or any third party arising out of the sale or use of goods or services provided by any merchant. If you have a dispute with a participating merchant, please report the dispute by contacting PerksCard Customer Service for recording purposes. However, you must resolve the dispute directly with the participating merchant. Reports must be submitted and mailed in written form with the following information: merchant name, merchant address, date of purchase, discount denied and purchase information. AUGEO IS NOT LIABLE FOR ANY PRODUCTS OR SERVICES PROVIDED BY OR THROUGH ANY MERCHANT WHO PARTICIPATES IN THIS DISCOUNT PROGRAM, OR FOR ANY ERROR, OMMISSION OR INACCURACY IN ADVERTISING MATERIAL OR FOR ANY LIABILITY RESULTING DIRECTLY OR INDIRECTLY FROM A PRODUCT OR SERVICE PROVIDED BY ANY MERCHANT OR OTHER THIRD PARTY IN CONNECTION WITH THIS DISCOUNT PROGRAM.
On the Site, Augeo provides links to selected merchants for your convenience only. Augeo is not responsible for the contents of any off-site pages referenced. Referencing off-site pages or any commercial product or service does not necessarily constitute or imply its endorsement or recommendation by Augeo. Neither Augeo nor any of its employees makes any warranty, express or implied, or assumes any legal liability or responsibility for the accuracy, completeness or usefulness of any information from links or documents available on the Site.
10. E-mail Policy and Communication Preferences
Cardholders have the option to receive PerksCard e-mail and/or mobile phone updates when they register their PerksCards online. PerksCard uses these updates to provide additional savings, special offers, site upgrades, new features, events, promotions and more. You have the option to e-mail us to opt out from receiving these e-mails using the link at the bottom of any promotional e-mail you may receive. You also have the option to email PerksCard Customer Service to opt out of receiving the mobile phone messages. Cardholders can also update these preferences by logging into their account on www.perkscardnetwork.com.
Augeo reserves the right to e-mail you with information essential to your participation in this discount program (for example, information on lost passwords, PerksCard shipment information and PerksCard expiration/renewal). You will not have the option to opt-out of e-mails of this nature.
11. Bulk Enrollment
Once you receive your PerksCard and materials, you must visit www.perkscardnetwork.com to register your account and this will confirm you have received your PerksCard. You must register your PerksCard to receive the full savings, benefits and services of it. Additionally, at this time, you must complete any missing information on your account.
12. Changes to Offers or Merchants
Offers made available through the PerksCard may change from time to time. Augeo reserves the right in its sole discretion to change the offers and/or participating merchants at any time. In addition, merchants may elect to change offers from time to time. Augeo will make commercially reasonable efforts to make appropriate updates to the Site to reflect offer and/or merchant changes. For a listing of current offers, Cardholders should visit www.perkscardnetwork.com. If you become aware of a discontinued offer listed, please notify Augeo by sending an e-mail to firstname.lastname@example.org or contacting PerksCard Customer Service. Augeo undertakes no obligation to provide a replacement or substitute offer for any offer discontinued.

to provide more efficient service and competitive terms to those clients for whom we
consider the use of such facilities appropriate.
Contingent Commission (sometimes referred to as “profit sharing”) which can be based on
profitability, premium volume and/or growth. If any part of your account is on a fee basis,
we will not accept contingent commissions related to your account.
If you have any questions regarding the nature or amount of the compensation paid to any Augeo company on your account, we encourage you to contact the head of the Augeo office that services your account.
In addition, Augeo has committed to provide, upon request, detailed year-end summary information to our clients on compensation we receive from insurers or other third parties in connection with the placement, renewal, consultation on or servicing of policies.
